{"id":1934,"date":"2024-03-23T15:37:32","date_gmt":"2024-03-23T15:37:32","guid":{"rendered":"https:\/\/queervibesmag.com\/?p=1934"},"modified":"2024-03-23T15:37:34","modified_gmt":"2024-03-23T15:37:34","slug":"uganda-dismissal-smugs-petition","status":"publish","type":"post","link":"https:\/\/queervibesmag.com\/es\/uganda-dismissal-smugs-petition\/","title":{"rendered":"Un tribunal ugand\u00e9s desestima un recurso de una organizaci\u00f3n de defensa de las personas LGBT"},"content":{"rendered":"<p><strong><em>Uganda desestima la petici\u00f3n de SMUG<\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Reciente rev\u00e9s jur\u00eddico para la comunidad LGBT ugandesa : Uganda desestima la petici\u00f3n de SMUG<\/h2>\n\n\n\n<p>En un reciente acontecimiento judicial que socava los derechos a la libertad de asociaci\u00f3n y expresi\u00f3n en Uganda, el tribunal de apelaciones desestim\u00f3 una demanda de Sexual Minorities Uganda (SMUG). Este grupo, que defiende los derechos de la comunidad de lesbianas, gays, bisexuales y transexuales, pretend\u00eda obligar al gobierno a reconocer oficialmente su nombre. El tribunal desestim\u00f3 la petici\u00f3n, declarando que el nombre del grupo contradice el \"inter\u00e9s p\u00fablico\". En consecuencia, sin un registro oficial -que se deneg\u00f3 a SMUG en agosto de 2022 por incumplimiento de los requisitos de la Oficina de ONG-, la organizaci\u00f3n no puede funcionar legalmente.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Primer a\u00f1o de la Ley contra la homosexualidad<\/h2>\n\n\n\n<p>El pa\u00eds tambi\u00e9n celebra el primer a\u00f1o desde la promulgaci\u00f3n, el 21 de marzo de 2023, de la Ley contra la Homosexualidad (AHA), considerada una de las leyes contra la comunidad LGBT m\u00e1s severas del mundo, ratificada por el presidente Yoweri Museveni. Actualmente, el Tribunal Supremo est\u00e1 evaluando las impugnaciones de esta ley opresiva presentadas por varios defensores de los derechos humanos, periodistas, acad\u00e9micos y figuras religiosas. Esta legislaci\u00f3n forma parte de una ofensiva gubernamental m\u00e1s amplia dirigida no s\u00f3lo contra los derechos de las personas LGBT, sino tambi\u00e9n contra otros segmentos de la sociedad civil, incluidos los defensores del medio ambiente.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Larga batalla por el reconocimiento jur\u00eddico<\/h2>\n\n\n\n<p>Desde su creaci\u00f3n en 2004, el SMUG ha participado activamente en iniciativas educativas sobre sexualidad y en la defensa de los servicios sanitarios. Sin embargo, lleva m\u00e1s de diez a\u00f1os encontrando obst\u00e1culos para obtener el reconocimiento legal. Su solicitud inicial de registro fue rechazada por la Oficina de Servicios de Registro de Uganda en 2012, alegando que el nombre de la organizaci\u00f3n era contrario al orden p\u00fablico. Adem\u00e1s, fue calificada de entidad delictiva en virtud del art\u00edculo 145 de la Ley del C\u00f3digo Penal, debido a la implicaci\u00f3n de \"minor\u00edas sexuales\" en su nombre y a su compromiso con personas que participan en conductas sexuales criminalizadas. Una decisi\u00f3n judicial anterior confirm\u00f3 esta sentencia en junio de 2018, que fue recurrida por SMUG.<\/p>\n\n\n\n<p>La decisi\u00f3n de la semana pasada volvi\u00f3 a confirmar la postura de anteriores sentencias judiciales, centr\u00e1ndose principalmente en la cuesti\u00f3n relacionada con el nombre de la organizaci\u00f3n. La sentencia subrayaba <a href=\"https:\/\/en.wikipedia.org\/wiki\/Sexual_Minorities_Uganda\">SMUG&#8217;s <\/a>compromiso de apoyar y defender los derechos de las personas LGBT, consideradas infractoras de la ley por la AHA.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Los defensores de los derechos humanos expresan su descontento<\/h2>\n\n\n\n<p>La sentencia ha provocado la consternaci\u00f3n de varios defensores de los derechos humanos, que ven en ella una oportunidad perdida para defender los derechos humanos esenciales de las personas LGBT, como las libertades de asociaci\u00f3n y expresi\u00f3n.<\/p>\n\n\n\n<p>\"Esto invalida todo el trabajo de defensa que se ha realizado durante a\u00f1os y otorga a la Ley contra la Homosexualidad y a todos los hom\u00f3fobos m\u00e1s poder sobre la vida, el cuerpo y los derechos de las personas\", explic\u00f3 a Human Rights Watch un defensor feminista y queer ugand\u00e9s.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Llamamiento al cambio por parte de las autoridades<\/h2>\n\n\n\n<p>La situaci\u00f3n en torno a SMUG pone de manifiesto las injustas y arbitrarias limitaciones impuestas a los defensores de los derechos humanos en Uganda.
