Kentucky Gay Couple Wins $100,000 : Kim Davis Marriage License Controversy Continues
A gay couple, David Ermold and David Moore, from Kentucky, were awarded $100,000 by a federal jury after a former county clerk, Kim Davis, denied them a marriage license. Davis, who identifies as a born-again Christian, had previously made headlines in 2015 for refusing to issue a marriage license to another gay couple, citing “God’s authority.” Following this, she was jailed for five days, only to be released when her team issued the licenses, but with her name removed from the forms.
In 2019, Davis faced legal action for denying a license to Ermold and Moore. She then argued that she couldn’t be sued due to her sovereign immunity from her 2015 lawsuit. However, it was later determined that she could be sued individually. Last year, Judge David Bunning ruled that Davis had violated the couples’ constitutional rights by denying them marriage licenses.
Recently, a follow-up trial took place in Ashland, Kentucky, to determine the damages against Davis. At the end of this trial, the jury decided to award $50,000 to each of the two men, Ermold and Moore. Another couple, James Yates and Will Smith, who had also filed a lawsuit against Davis, received no compensation.
After the verdict, Mat Staver, from the evangelical Christian law firm Liberty Council, representing Davis, stated they were considering appealing this decision to the US Supreme Court. However, it remains to be seen if Davis can appeal, as the US Supreme Court had previously declined to hear a similar appeal from her lawyers in 2020.
