California Prohibits Forced Outing of LGBTQ+ Students with New Law

California Prohibits Forced Outing by enacting a pioneering law that bans schools from forcibly outing these students to their parents or guardians. Governor Gavin Newsom signed Assembly Bill 1955 on Monday, making California the first state to implement such a prohibition.
Protection of Student Privacy
The newly signed law prohibits schools from revealing a student’s gender identity or sexual orientation to their guardians without the student’s consent. Additionally, the California Department of Education is now mandated to provide resources to families to help them navigate conversations about gender and identity in a private manner.
Response to Conservative District Policies
This legislative move responds to the actions of several conservative school districts in California that had adopted policies requiring school staff to inform guardians if a student’s gender identity differs from their sex at birth. Notably, California Attorney General Rob Bonta filed a lawsuit against the Chino Valley Unified School District last year, arguing that such policies put transgender students at risk of “imminent, irreparable harm.”

Nationwide Context and Legal Landscape
Currently, eight states—Alabama, Idaho, Indiana, Iowa, North Carolina, North Dakota, South Dakota, and Tennessee—have laws that mandate the forced outing of transgender students in schools. Other states, including Arizona, Florida, Kentucky, Montana, and Utah, encourage this practice, although it is not codified into state law. In contrast, California stands alone as the only state to outlaw forced outing.
Advocacy and Legislative Intent
Assemblymember Chris Ward, the author of the bill, emphasized the importance of the law in ensuring that educators are not forced into the role of “gender police” and that it upholds the integrity of the parent-child relationship. Speaking to the Los Angeles Times, Ward stated, “Politically motivated attacks on the rights, safety, and dignity of transgender, nonbinary, and other LGBTQ+ youth are on the rise nationwide, including in California. As a parent, I urge all parents to talk to their children, listen to them, and love them unconditionally for who they are.”
